Hindus, Sikhs, Christians, Buddhists, Jains, and Parsis who arrived in India before December 31, 2014, from neighboring Muslim-majority nations including Pakistan, Bangladesh, and Afghanistan, now have a route to Indian”Citizenship under the CAA, which amends the provisions of the Citizenship Act of 1955.”

huge debate and huge protests throughout India were triggered by the CAA’s passage. Critics said that it undermines the secular values contained in the Indian Constitution and discriminates against Muslims. However, the administration defended the rule, claiming it was a humanitarian measure meant to shield religious minorities from neighboring nations who were being persecuted.

The study does, however, state that no proof of religious persecution would be looked for because it will be assumed that individuals who departed did so because they were being persecuted or were afraid of being persecuted.

On December 11, 2019, Parliament passed the CAA, and on December 12, that same year, notice was given. Nevertheless, the controversial law has not been put into effect because the regulations were not announced.

CAA

In a speech at the ET-Now Global Business Summit (GBS) in Delhi earlier this month, Home Minister Amit Shah declared, “The CAA is the national law.” It will be informed prior to the next Lok Sabha elections. There ought to be no room for misunderstanding.”

It was a government of Congress promise. The Congress guaranteed refugees that they would be welcomed in India and granted Indian citizenship during the time the country was divided and minorities were being persecuted in foreign countries. However, they withdrew,” Shah stated, stressing that the CAA’s goal is to give Indian citizenship to non-Muslim immigrants who are facing persecution in Bangladesh, Pakistan, and Afghanistan.

The Election Commission of India (ECI) has the authority to announce the provisions of the Citizenship (Amendment) Act (CAA) prior to the Lok Sabha elections, as reported by India Today TV, which cited reliable sources.

Home Minister Amit Shah recently reaffirmed that the absence of such provisions does not strip anyone of their citizenship and announced that the CAA will be informed prior to the Lok Sabha elections.

“Our Muslim brothers are being misled and incited (against the CAA),” stated Shah. Citizenship by implication (CAA) is limited to individuals who fled persecution in Bangladesh, Pakistan, or Afghanistan and arrived in India. It is not intended to revoke anyone’s Indian nationality.”

Additionally, he claimed that the Congress administration had made a pledge with the CAA and charged them with breaking that promise to grant Indian citizenship to refugees from the aforementioned nations.

It’s possible that the Code of Conduct will go into effect in March. The regulations are prepared, and a digitally powered online portal has already been set up for the entire procedure.

According to sources cited by the ANI news agency, applicants will not require any further paperwork and only need to disclose the year of their admission into India without any trip documentation.

The objective of the proposed CAA by Prime Minister Narendra Modi’s government is to provide Indian citizenship to persecuted non-Muslim immigrants from Afghanistan, Bangladesh, and Pakistan who arrived in India before December 31, 2014.

The Citizenship Act of 1955 will be amended by the CAA 2019 to give non-Muslim immigrants from Afghanistan, Bangladesh, and Pakistan who arrived in India on or before December 31, 2014, owing to religious persecution, a quicker route to Indian citizenship. The CAA’s implementation provoked protests in Delhi’s Shaheen Bagh and opposition meetings in Guwahati, Assam, even though it was adopted by Parliament in December 2019 and then authorized by the President.

More than a hundred individuals were killed either during these protests or as a result of police force after the law was implemented. Lockdowns and restrictions brought on by the coronavirus, however, caused the protests to fade.

The CAA has not been put into effect more than four years after Parliament enacted it because the regulations and procedures have not been finished.
